{"id":10279,"date":"2011-09-29T09:00:28","date_gmt":"2011-09-29T13:00:28","guid":{"rendered":"http:\/\/accessniagara.com\/blog\/?p=10279"},"modified":"2014-02-18T12:24:41","modified_gmt":"2014-02-18T17:24:41","slug":"send-killer-whale-back-to-florida-court-tells-marineland","status":"publish","type":"post","link":"http:\/\/accessniagara.com\/blog\/2011\/09\/29\/send-killer-whale-back-to-florida-court-tells-marineland\/","title":{"rendered":"Send killer whale back to Florida, court tells Marineland"},"content":{"rendered":"<p>From the <a href=\"http:\/\/www.thestar.com\/news\/gta\/2011\/09\/28\/send_killer_whale_back_to_florida_court_tells_marineland.html\">Toronto Star<\/a>:<\/p>\n<blockquote><p>Ontario\u2019s Court of Appeal has upheld a lower court decision ordering Marineland to return a killer whale to the Florida water park that loaned it out.<\/p>\n<p>In July, an Ontario Superior Court judge ordered the Niagara Falls amusement park to return Ikaika, a 9-year-old male orca, to SeaWorld, the Orlando, Fla.-based owner.<\/p>\n<p>The initial ruling focused on legal technicalities surrounding the \u201cbreeding loan agreement\u201d between the two parks.<\/p>\n<p>Marineland appealed the decision, but the appeals court echoed the sentiments of the previous ruling in rejecting its court challenge.<\/p>\n<p>\u201cThe breeding loan agreement is not a long term agreement.
